General conditions of sale and use

Rule n° 1 : generality

luciollle is edited by Noir de Monde, BE 0723.983.551. The www.luciollle.com site is intended only for consumers wishing to order luciollle^® products online for delivery in Europe. The terms under which the products of this site www.luciollle.com are offered for sale are set out below. By checking the box "I have read and I accept" the order form, then by sending the order, you agree to be bound by these terms. luciollle^® reserves the right to change these terms at any time without notice. Nevertheless, the said change will not affect orders placed before the posting of modified terms on the website www.luciollle.com. Photos of the products are not contractual.

Rule n° 2 : order

2.1. To place an order, you must be at least 18 years old, be able to be contacted by phone and have a valid e-mail address.

2.2. You can order by:

2.2.1. filling out the form on the website www.luciollle.com after logging in to your personal account, or after creating it, and clicking on the corresponding send button or

luciollle reserves the right to refuse any order placed in any other way than those listed above.

2.3. When you place an order, luciollle assigns you an order number. luciollle does this through its website www.luciollle.com, unless you have placed an order by email, in which case luciollle will provide you with the order number by email return. You should know that the said order number www.luciollle.com is provided for reference only and does not constitute the acceptance of your order by luciollle.

2.4. By placing an order, you offer to purchase the products you have selected in accordance with these terms. luciollle may or may not accept your proposal, for reasonable reasons, or may reduce the number of products that the company agrees to deliver depending on the availability of stocks in particular. However, you are bound by the orders you send; these can not be canceled after they have been sent.

2.5. If luciollle accepts your order, you will be notified by an order confirmation. luciollle will send you the order confirmation by e-mail. It will take effect on the date on which the confirmation will be sent to you. If your order is not acceptable, luciollle will try to contact you by e-mail, telephone or mail as soon as possible.

2.6. You should know that the display of colors, designs or products on a screen may differ from the actual appearance or size of the products offered on the website www.luciollle.com.

Rule n° 3 : delivery

Subject to these terms, luciollle will provide you with the products indicated on the order confirmation.

Rule n° 4 : price

4.1. All prices are given in euros. The prices applied are those published on the website www.luciollle.com at the time of sending the order. Rates published on the website www.luciollle.com include VAT and recycling fees, but do not include shipping and handling charges, or fees, applicable to your account. These costs are calculated separately as applicable and specified on your order form and added to the total cost of your order. The total cost indicated on the order form you send corresponds to the total amount of your product charge, including all taxes, recycling fees, handling and shipping fees and charges.

4.2. It is not possible to make intra-community purchases through the website www.luciollle.com

4.3. Delivery charges, if any, are your responsibility as indicated on your invoice.

Rule n° 5 : payment of products 

5.1.You can pay for the products by using one of the following payment methods:
- Visa Card
- MasterCard
- Bancontact
- Paypal

These payments will be made on a secure platform. luciollle's partner is the secure European payment platform Stripe (https://stripe.com). Only this legally trusted third party has access to your bank details during the secure transaction period.

5.1.1. For orders by email, the products can be paid by bank transfer.

5.2. You have to pay in euros.

5.3. If you pay by credit card, you must provide all the information about it when you place an order. In case of payment by credit card, the debit is effective at the time of sending the products. luciollle will not provide you with the products or provide services until the bank has authorized payment by credit card, bank card or Paypal, products and / or services ordered. If luciollle does not obtain the said authorization, you will be informed. luciollle, or its technical partner, reserves the right to verify the identity of the credit card holder by claiming the appropriate documents.

Rule n° 6 : product delivery

6.1. Orders placed on www.luciollle.com can be delivered in Europe.

6.2. luciollle will deliver the products indicated on the order confirmation to the delivery address you indicated on the order form, according to the option you have chosen and the deadline indicated by luciollle on the order form.

In the event that you order multiple products to be delivered to different addresses, you will need to send a different order form for each delivery address.

In the event that the ordered products are not in stock, it could mean the postponement of the order as a whole. If this is the case, in case of delay of shipment, an email will be sent to inform you of a possible consequence on the delivery date that has been indicated.

In case of delay of delivery, we will propose you by mail a new date of delivery. In any case, in case of delay of more than 7 days, you have the possibility, to cancel your order within 30 working days, in accordance with the legal provisions. In this case, if you received the product after your cancellation, we will refund the product and the cost of return, upon receipt of it by us, complete and in its original condition, at the latest in the thirty days of payment of the sums you have paid.

6.3. The ownership and the risk of loss related to your products are transmitted to you at the moment of their delivery.

6.4. At the time of delivery of the products to the carrier, you will send a confirmation of sending by e-mail, provided you have provided an e-mail address on the order form or by mail. luciollle can not be responsible for late delivery due exclusively to the unavailability of the customer after several proposals for appointments by the carrier.

Rule n° 7 : exchanges, returns and refunds 

7.1. You can return the product to luciollle at 30 avenue de la Meute in 1470 Bousval Belgium or cancel the right to services and get a refund of the price of the returned product (with the exception of gift packaging and other such fees ) or the right to a service, provided that you contact luciollle within fourteen (14) calendar days from the date of delivery of the product.

You should know that you can not return a product and claim a refund if it is:
a) a product customized and / or adapted according to your own specifications. You can not get a refund for a service if you have already started using it.

b) As a hand-knit art craftsman product, each luciollle product is unique: small imperfections are part of the charm of the products and are by no means a defect, but rather a guarantee of authenticity.

7.1.1. If a product was provided in error, if it is incomplete or defective, and you believe that you are entitled to its replacement or repair in accordance with paragraph 8 below, contact luciollle by email or by phone at +32 (0) 475.522.724 from 10:00 to 16:00, Monday to Friday. In the event that you are entitled to replacement or repair in accordance with paragraph 8 below, the transportation costs referred to in paragraph 7.1 will not apply.

7.1.2. If you have received the purchased product (s), but have changed your mind about the purchase, you may return the product (s) or entitlement to the service to obtain a refund, subject to the payment of transportation costs and provided that:
I. You inform luciollle of your decision to cancel the contract within fourteen (14) calendar days from the date of delivery of the product or the date of purchase of the services and
II. The product (s) are returned to their original condition and the security seals of the product (s) are intact and
III. The product or products are returned in accordance with paragraph 7.2. below.

Please note that when products are in your possession, you must ensure that they are stored appropriately and securely.

Refunds of the products in the cases referred to in Articles 7.1.1 and 7.1.2 shall be made as soon as possible and at the latest within 30 days of the date on which the right was exercised.

7.2. Procedure to claim a refund:
(i) Contacter luciollle by email or by phone at +32. (0) 475.522.724, from 10:00 to 16:00, Monday to Friday, to arrange the return.

(ii) luciollle will then organize the removal of the products by the carrier of his choice. According to the carrier, luciollle will tell you if you will need to contact him or - in the case of bulky items - he will contact you to make an appointment for the removal.

(iii) Before returning a product, please check that you have:
1. obtained an RMA number from luciollle (assigned on request),
2. includes all accessories, warranties provided and any other accompanying documentation, unless otherwise stated,
3. used all the packaging originally provided,
4. clearly indicate the return address and the RMA number and
5. sealed the package carefully.

6.The returned product must be complete, packed in its original packaging, accompanied by the user manuals and other accessories initially delivered, as well as all the documentation of the supplier.

7. In the event of an abusive return, luciollle reserves the right to refuse a subsequent order.

(iv) Compliance with this procedure ensures that products arrive at the right destination, in good condition and within a reasonable time. You should know that if you do not follow this procedure, products may be refused on arrival and you may lose your right to a refund.

(v) Please note that luciollle reserves the right to refuse products that are not returned in accordance with the provisions set out above and, in particular, paragraphs 7.1.2 and 7.2.

Rule n° 8 : warranty

8.1. Product warranty of the brand luciollle

luciollle warrants the products as described on the warranty card supplied with the products and / or as may be indicated on the website www.luciollle.com. Special warranties may apply to certain products (such as custom products) as detailed on www.luciollle.com.

luciollle can not be held responsible for damage to equipment or facilities due to weather conditions such as storms, snow, hail, water infiltration, lightning, etc ..., failures caused by a surge in the network electrical, failures caused by the improper connection of devices and cables by the customer, wear or failures due to improper maintenance, overheating due to the use of a bulb too powerful.

In the event that the product supplied by luciollle does not comply with the applicable warranty, luciollle repair or replace the product or refund the purchase price, after return of said product, at its discretion and at its expense, subject to a different provision in the applicable warranty.

Except as expressly set forth herein, luciollle hereby disclaims all warranties, whether express or implied, to the fullest extent permitted by law. The limited warranty described above will not affect or prejudice your legal rights.

8.2 Third party products or a brand other than luciollle
For non-branded products (including third party branded products in sets or promotions), all warranty claims, if any, must be made in accordance with the manufacturer's standard warranty terms. can be included with purchased products. In the case of an existing manufacturer's warranty, any claim must first be made either directly from the manufacturer or from luciollle by email.

8.3 luciollle declines any responsibility in case of misuse of our products, improper handling, as well as anchoring points and the upstream electrical installation that everyone is required to check regularly.

8.4. IF YOU ARE A CONSUMER, THE WARRANTIES REFERRED TO ABOVE SHALL COMPLY WITH YOUR LEGAL RIGHTS AND DO NOT AFFECT THEM.

Rule n° 9 : luciollle responsibilities

9.1. These terms outline the full extent of our obligations and responsibilities with respect to the provision of products (and the provision of telephone support and warranty services) and the provision of any service.

9.2. Except as described in paragraph 9.3 below, there are no warranties, conditions or other terms binding on the supply of the Products or the provision of Services, other than which is expressly stated in the contract.

9.3. Any warranty, condition or other term arising out of or relating to the supply of the goods and / or the provision of services, that might otherwise be implied in the contract or incorporated in the contract by law, customary law, applicable laws in the country where you purchased the goods or services or otherwise (including, but not limited to, any implied term of quality, fitness for purpose, due diligence and skill) is expressly excluded by this the measure authorized by law. It will not be incumbent on, among other things, to make sure that the products are adapted to the use you reserve for them and that luciollle could not reasonably have envisaged.

9.4. Nothing in the Contract shall limit or exclude our liability in the event of (i) death or injury caused by our negligence or (ii) fraud or (iii) any breach of the implied obligations of any applicable national laws relating to the property or (iv) any liability that can not be excluded by law.

9.5. SUBJECT TO CLAUSE 9.4, luciollle SHALL NOT BE LIABLE UNDER THIS AGREEMENT FOR ANY LOSS OF INCOME, LOSS OF PROFIT, LOSS OF CONTACTS, LOSS OF DATA OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE OF ANY NATURE WHATSOEVER. THIS IS DUE TO THE PURCHASE OF A PRODUCT. IN THE EVENT OF A PROFESSIONAL PURCHASE, THE EXTENT OF LIABILITY OF luciollle, UNDER THIS CONTRACT, DELICATELY (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL IN NO CASE EXCEED THE AMOUNT YOU ARE LIABLE TO luciollle IN THE MATTER OF THE PRODUCTS AND / OR SERVICES IN QUESTION.

9.6. This does not affect your legal rights as a consumer, nor your right to return products under clause 7.

Rule n° 11 : data protection (GDPR or RGPD)

11.1. You can access the details of your transactions if you are a registered customer. Enter the order number on www.luciollle.com to check the status of your order and its contents.

11.2. By placing an order, you agree and understand that luciollle may store, process and use the data collected on your order form in order to process your order. This data will be processed in accordance with luciollle's privacy statement, which you can consult by clicking on the "Legal notice" button located at the bottom of this website www.luciollle.com.

Rule n° 12 : circumstances beyond the reasonable control of luciollle 

luciollle will strive to meet its obligations under its contract. Nevertheless, luciollle can not be held responsible for any delay or failure to respect them if the said delay or failure results from circumstances beyond its reasonable control. In the event of a delay, luciollle will respect its obligations as quickly as possible.

Rule n° 13 : applicable law and jurisdiction in case of dispute

These conditions are subject to and governed by Belgian law, luciollle will endeavor to resolve quickly, efficiently and amicably any dispute. If you are not satisfied with the manner in which luciollle is handling a dispute and you intend to engage only the courts of the judicial district of Nivelles - Belgium are competent; whatever the place of delivery and payment methods accepted. The applicability of the United Nations Convention on Contracts for the International Sale of Goods is hereby expressly excluded.

Rule n° 14 : generalities

14.1. Neither the failure of luciollle to implement any condition of the contract, nor yours, constitutes an abandonment of the said condition. Such a breach can in no way affect the right to implement the condition at a later date.

14.2. The unenforceability or nullity of any provision of the contract shall not affect the enforceability and validity of the remaining provisions.

Rule n° 15 : special conditions in the case of personalization/adaptation 

15.1. Order and acceptance of personalized products

Even though luciollle designs most of the requested designs, luciollle can not design them all. Some may include, in particular, third party trademarks that you (or luciollle) are not allowed to use. Others may contain materials that we consider unsuitable or that we simply do not want to include in our products. Unfortunately, this may sometimes mean that luciollle refuses your order, even though it meets all the other criteria. If your design is not acceptable, in our opinion, your order may be refused immediately or your purchase may be canceled later; In this case, you will be notified by e-mail or by post and luciollle reserves the right to cancel the corresponding order confirmation.

15.2. Restrictions on content

You agree not to use the site www.luciollle.com or service:
A. to download, post, transmit or otherwise communicate, any content for any illegal purpose or any material that is obscene, insulting, profane, pornographic, sexual, fraudulent, threatening, abusive, harmful, inquisitive, defamatory, vulgar, violent or condemnable in any way,
B. to upload, post, transmit or otherwise communicate any celebrity or image content, regional, national or international leaders or politicians, current or past world leaders, criminals found guilty, images or individuals news or public knowledge or any content with an old appearance or images of a bygone era,
C. to upload, post, or otherwise transmit or communicate any Content that you are not authorized to transmit or communicate by any contractual or fiduciary link, or that infringes any copyright, trademark, patent or any other intellectual property right or any moral right of any third party
D. to download or transmit any content that may cause harm to the site www.luciollle.com or to anyone's computer systems, including but not limited to, which may contain a virus, code, worm, data or any other file or program designed to damage or allow unauthorized access to the www.luciollle.com website or which may result in a failure, error, malfunction or corruption of the service
E. You agree that in the event that luciollle decides, in its sole discretion, that any content you submit does not meet its requirements, luciollle will refuse your order.
In the event that you fail to comply with any of the content restrictions and voluntarily make this violation public, you will recognize that the reputation of lucid is seriously affected and that you may be held liable for such harm.
Your product design or adaptation (eg combination of colors) must be your own creation or, as long as this is not the case, you hereby warrant that you are authorized to use the design or adaptation created by a third party.

You must understand that, although luciollle reserves the right to refuse your design or adaptation, you are fully responsible for your design or adaptation and luciollle is under no obligation to examine it.

By sending your order to luciollle, including your design or adaptation, you grant luciollle a permanent, non-exclusive, royalty-free license to use your design or adaptation in the broadest sense of the word. in particular, without limitation, to copy, modify, scan or reproduce your design or your adaptation to meet your request for creation and delivery of a personalized product.

Your design and your adaptation correspond to what luciollle describes as "User Content". The article about User Content in paragraph 6 of the Terms of Use, which can be viewed by clicking on the "Terms of Use" link at the bottom of the www.luciollle.com website, applies to your design and your adaptation, with the exception of any differences it may present regarding user content; in this event, the article in this document supersedes and cancels it.
